Neutral Moon Studio LLC Training Event Terms and Conditions

This agreement between the undersigned company (hereafter “COMPANY”) and the undersigned client, (hereafter “PARTICIPANT(S)”) governs the assignment (hereafter “COMPANY” or “EVENT(S)”) described in the accompanying event contract, and along with these Terms and Conditions, constitutes the entire agreement between the parties concerning that assignment.

ENTIRE AGREEMENT: This agreement contains the entire understanding between the COMPANY and the PARTICIPANT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement. All correspondence in regard to this agreement will be done by the COMPANY with the PARTICIPANT(S) via one or both of the aforementioned PARTICIPANT email addresses only. The COMPANY declines any request to discuss this agreement via text message.

INTELLECTUAL PROPERTY RIGHTS: All Intellectual Property Rights in and to EVENTS and in the Content relating to EVENTS are the property of the COMPANY. THE COMPANY may provide a license to third parties, including Event Sponsors, to use the content at the COMPANY’s sole discretion. PARTICIPANTs may use the content solely for their own personal use and benefit and not for resale, distribution or other commercial purposes. The COMPANY does not guarantee that any of the content or information obtained by the CLIENT from the EVENT will result in any particular outcome.

RETAINER & BALANCE PAYMENTS: A retainer payment is due at the time of booking to hold a spot for any training event. Retainer payments are non-refundable and non-transferable after 24 hours from original payment date. If applicable, the remaining balance is due no later than 24 hours prior to the training event start time. Failure to submit balance payment on time will result in non-entry into the EVENT.

CANCELLATION OF EVENT (FORCE MAJEURE): Retainer payments are non-refundable and non-transferable after 24 hours from original payment date. The COMPANY is under no obligation to refund any monies received, balance payment included, due to the EVENT being postponed due to reasons including but not limited to weather, injury, illness, death in the family, act of God, act of terrorism, government mandated orders, building closures by building owner/management, or any other cause beyond the control of either the PARTICIPANT or COMPANY. The COMPANY will make every effort to re-schedule a cancelled EVENT and transfer the PARTICIPANT’s deposit to either the re-scheduled EVENT date or a future EVENT date if applicable. If the PARTICIPANT cannot attend the re-scheduled EVENT date or any future EVENT date, the COMPANY will refund 100% of the retainer payment. The PARTICIPANT agrees that the COMPANY is not liable for any other fees related to an EVENT cancellation including but not limited to travel fees (such as airline, hotel, and ground transportation).

RE-SCHEDULING AND TRANSFERRING OF EVENT TICKET: Retainer payments are non-refundable and non-transferable after 24 hours from original payment date. Each EVENT ticket corresponds to (1) PARTICIPANT at a time. If a registered PARTICIPANT is unable to make the scheduled EVENT, the PARTICIPANT may transfer their ticket to another person by emailing the person’s contact information to hello@neutralmoon.com no later than 24 hours prior to the EVENT start time. Failure to communicate a ticket transfer on time will result in non-entry for any PARTICIPANT under the corresponding deposit.

PARKING: PARTICIPANT may park in the designated parking lot associated with the 'Koncept House' property building or anywhere where it is legal to park. The COMPANY is not liable for a PARTICIPANTs vehicle (or any fees associated with illegal or prohibited parking) while parked during an EVENT.

ATTENDANCE REQUIREMENTS: PARTICIPANT shall: (a) observe the rules, policies and procedures of the EVENT venue including in relation to health and safety and any reasonable instructions issued by the COMPANY and/or the management of the EVENT venue and/or the Online Event Platform; (b) behave in a respectful, professional and appropriate way that does not breach the laws or regulations of their home country or of the host country or that risks bringing the EVENT or the COMPANY into disrepute; (c) ensure they have adequate insurance for their own requirements, including personal accident and travel insurance, prior to attending any EVENT; and (d) ensure they have all necessary travel documentation, including but not limited to visas and other entry permits into the country where the EVENT is held, and that they comply with all health formalities and any applicable laws. PARTICIPANT agrees that their travel to and attendance at an EVENT is at their own risk and not the responsibility of the COMPANY,. The COMPANY is not obliged to provide any advice or assistance relating to the obtaining of visas. Failure by any PARTICIPANT to obtain a visa to attend an EVENT shall not entitle them to a refund of any fees.PARTICIPANT is only permitted to conduct business within a designated exhibit space at the EVENT venue.

SECURITY CAMERA AND SURVEILLANCE: The COMPANY reserves the right to install a security camera to record all activities inside the STUDIO 24 hours a day. Video footage will be viewed upon discovery of damaged or stolen items owned by the COMPANY.

PARTICIPANT OBLIGATION: The COMPANY reserves the right to refuse entry by any PARTICIPANT to an EVENT or to remove any PARTICIPANT from an EVENT or block them from an Online Event Platform without any liability for any reason and at its sole discretion.

DAMAGE & THEFT: In case of damage reported by a COMPANY representative or footage from the installed security camera immediately after the PARTICIPANT has exited the studio, the COMPANY reserves the right to charge the PARTICIPANTs credit card on file for any damages caused by the PARTICIPANT during the EVENT. Damage fees will total the original value of the damaged item when purchased by the COMPANY. In case of theft reported by a COMPANY representative or footage from the installed security camera immediately after the PARTICIPANT has exited the EVENT, a police report will be filed.

VENUE AND LOCATION LIMITATIONS: The COMPANY is limited by the rules and guidelines of the location(s) and building management. The PARTICIPANT agrees to accept the technical results of their imposition on the COMPANY. Negotiation with the officials for moderation of guidelines is the PARTICIPANT’s responsibility; the COMPANY will offer technical recommendations only. Animals and pets are not allowed in 'Neutral Moon Studio' or 'The Koncept House'.

SAFETY AND CONDUCT: The COMPANY reserves the right to terminate the EVENT and/or ask PARTICIPANTs to leave the EVENT if the COMPANY or other participants experience inappropriate, threatening, hostile or offensive behavior from any person(s) at the EVENT(S); or if the safety of the COMPANY or other participants at the EVENT is in question.
